Danielle Dietrich

Danielle Dietrich is a Partner with over twenty years of law firm experience whose practice focuses on litigation as well as the needs of small and diverse owned businesses and health care providers, including long term care. With specialized expertise in the representation of Small, Disadvantaged, Disabled, Minority, Women, Veteran and LGBT-owned businesses, Danielle serves as outside general counsel for these businesses in a variety of areas and helps them resolve legal needs, such as contract matters, intellectual property issues, collections, employment issues and corporate governance and growth.

In particular, Danielle assists businesses with obtaining and maintaining diversity certifications and represents companies applying for Disadvantaged Business Enterprise (DBE) certification through the United States Department of Transportation DBE Program and state agencies. She reviews corporate documentation before the application to identify and resolve potential problem areas before submitting the application. She also represents companies in the appeal process when their DBE, WBE, MBE, WOSB, EDWOSB, VOSB, and SDVOSB certification applications are denied, or when certifications are at risk of being revoked.

Danielle has broad litigation experience and has received favorable verdicts for her clients in federal and state bench and jury trials, arbitration, and administrative and regulatory proceedings. Her clients include small businesses, large corporations, public utilities, universities, businesses, school districts, individuals, and hospitals in a wide variety of claims, including contract disputes, theft of trade secrets, violations of restrictive covenants and employment agreements, property damage, premises liability, and collections.

Representative Experience

• Successfully tried both jury and bench trials, including a commercial case resulting in a $1,050,000 jury verdict.
• Conducted all pretrial activities, including drafting and responding to discovery, conducting depositions, internal investigations, oral arguments, mediation, arbitration, negotiations, hearings, jury selection and jury trials in a wide variety of cases, including products liability, shareholder disputes, insurance coverage, and breach of contract.
• Represent women and diverse-owned businesses with obtaining and maintaining diversity certifications, such as Disadvantaged Business Enterprise (DBE) through the U.S. Department of Transportation, Minority Business Enterprise (MBE), and Women Business Enterprise (WBE). This includes reviewing applications, handling appeals to state agencies and the U.S. Department of Transportation, advising on decertification proceedings, and assisting clients with strategies to maintain their certifications.
• Assist medical providers including skilled nursing facilities, assisted living facilities, personal care homes, and private medical practices with a variety of issues, including Medical Assistance-Long Term Care advice and appeals, guardianships, disputes with agents under power of attorney, HIPAA compliance, drafting policies, and Orphan’s Court litigation.
• Represented several major mass/toxic tort clients locally and nationally.
