Potomac Law Group LLC’s International Trade practice includes attorneys with expertise in the multi-layered regulatory controls governing imports and exports.  We have represented importers and exporters in enforcement actions by various federal agencies, and have provided import and export compliance services, ranging from advice on discrete legal and logistical issues to the development of comprehensive compliance programs tailored to the needs of our clients’ operations.

Unfair Trade Litigation.   Our attorneys have decades of experience litigating unfair trade actions (antidumping, countervailing duty, safeguards) on behalf of both foreign and U.S. producers.   We have represented corporations, industries and associations in matters before the U.S. International Trade Commission, the U.S. Department of Commerce, Import Administration, the U.S. Court of International Trade, U.S. Court of Appeals for the Federal Circuit, NAFTA and WTO Panels, and other tribunals.   We’ve also been successful in advocating trade issues in meetings with senior officials at the USTR and the White House.

Customs and Border Patrol.   We offer a wide ranging suite of legal services for importers on such vital customs matters as tariff classification, valuation, country of origin marking, quotas, transfer pricing, related party transactions, seizures, and many others.  We have successfully challenged customs rulings and had them reversed at the agency level as well as in de novo actions in the U.S. Court of International Trade.  Other customs-related work includes: global tariff and value analysis; bonded warehouse operations; foreign trade zones; prior disclosures; duty drawback; compliance with homeland security regulations, including the Customs Trade Partnership Against Terrorism (“C-TPAT”); various import-related cost-reduction strategies.

Export Controls and Related Matters.   Our attorneys also have extensive experience representing U.S. and international clients in matters involving U.S. and ex-U.S. export controls, economic sanctions and related international trade and investment controls. We have represented corporations across a broad spectrum of industries, including aerospace and defense, IT technology, pharmaceuticals, and industrial manufacturing. Our attorneys have advised clients ranging from small and medium sized businesses to Fortune 100 companies regarding compliance with the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), Office of Foreign Assets Control (OFAC) sanctions and U.S. anti-boycott regulations.

Our export controls and sanctions attorneys provide a range of services, including commodity jurisdiction, licensing and agreement drafting and counsel; M&A and due diligence services; and internal assessments and audits. We also represent clients in preparing internal investigations and voluntary disclosures to relevant agencies as well as representation in any agency enforcement action including litigation support to our white collar litigation team. Our attorneys also offer customized training and compliance program services for clients new to exporting or needing to enhance their existing programs.
